VAT OSS audit and penalties – what are the consequences for errors, missing declarations and arrears?
One OSS declaration does not mean one controlling jurisdiction.
The country of consumption can check the VAT due to it, charge its own interest and penalties and – after an appropriate reminder stage – pursue payment directly.
Who can control the OSS VAT settlement?
The country of identification handles registration, declarations, and information transfer. The country of consumption retains the authority to control VAT due within its territory.
A company from Poland
He submits a declaration, pays the total amount and provides the records.
Poland
Receives VIU-DO, distributes data and payment, and forwards requests.
Control of your own VAT
Germany is examining VAT DE, France VAT FR and Italy VAT IT.
The European Commission confirms that the country of consumption requests records from the country of identification. The principles for data sharing are described in the official OSS Records and Controls.
What mistakes most often cause risk?
The office typically doesn't see a single field in isolation. It compares the declaration with records, goods flow, payments, platform data, and local settlements.
| Mistake | How does the office detect it? | Possible effect | Repair document | Owner of the intention |
|---|---|---|---|---|
| The wrong consumption state | Address, location evidence and country of delivery do not match VIU-DO. | Underpayment in one country and overpayment in another. | Transaction report with placement rule. | OSS VAT records |
| Incorrect rate or classification | Compare product code, description and country rate. | Arrears, interest and correction. | Dictionary of rates with effective date. | EU VAT rates |
| No shipping start country | The carrier and warehouse details do not match the indicated direction. | Incorrect assignment of sales to the declaration section. | Shipment report with source warehouse. | Foreign magazines |
| Local sales reported in OSS | The beginning and end of the transport are in the same country. | No local VAT return. | Local and STO transaction matrix. | OSS or local VAT |
| B2B sales treated like B2C | Customer VAT number, invoice and VIES status. | Incorrect taxation mechanism. | Verification of VAT ID and buyer status. | VAT OSS and B2B |
| ECB's wrong course | Comparison of the exchange rate date with the end of the billing period. | Difference in VAT base and amount. | ECB exchange rate table and conversion history. | VIU-DO Declaration |
| No zero declaration | Active registration without declaration for the period. | Reminder and risk of escalation. | UPO zero declaration. | VIU-DO Declaration |
| Correction in the wrong country or period | Returns cannot be combined with the original sale. | Incorrect balance of state consumption. | Linking the refund to the source transaction. | VAT OSS correction |
| No evidence of location | The basis for assigning a client to a country cannot be reconstructed. | Disputing the place of taxation. | Archived location evidence. | OSS VAT records |
| Data source incompatibility | VIU-DO is different from platform, JPK or local declarations. | Expanding the scope of control. | Source reconciliation and change history. | Invoices, JPK and platforms |
The scope of source data is discussed in the VAT OSS Records, and the method of correcting the previous settlement is discussed in the VAT OSS correction.
Sanctions and interest depend on the country of consumption
There is no single EU VAT OSS penalty schedule. A single source of error can result in different consequences, deadlines, and correspondence in multiple countries.

Payment is made when the money reaches the account
The transfer order date alone is not sufficient. The OSS deadline does not extend if it falls on a weekend or holiday, and the payment must be correctly linked to the declaration.
What counts is the impact of the measures
- the transfer must reach the correct account;
- the bank's processing time must be taken into account;
- an order placed on the last day does not guarantee timely payment.
In the title, enter only UNR
The Ministry of Finance indicates that additional description may make attribution more difficult and the payment may be rejected and returned.
Partial payment is divided proportionally
You cannot allocate the entire partial payment to your chosen country of consumption yourself.
When is the consumption state paid directly?
The answer depends on the stage of the case and which authority sent the letter. The most important rule: once the State of Consumption is reminded, the arrears are no longer paid to the State of Identification.
- Stage one
Maturity
The total amount of the declaration should be received no later than the end of the month following the period.
Payment to Poland · UNR - Stage two
Reminder of Poland
The country of identification sends it electronically on the tenth day after the deadline.
Still payment to Poland - Stage three
Transfer of the case
Further reminders and tax collection are transferred to the relevant country of consumption.
Check correspondence - Stage Four
Reminder of the country of consumption
The letter will indicate the local payment method and the appropriate reference number.
Direct payment - Stage five
Enforcement and sanctions
The procedures of the country to which the tax is due are applied.
Country risk
Who wrote the letter?
Check the UNR, amount and account indicated for OSS.
Do not pay interest into the account where you pay OSS VAT. You must pay it into the bank accounts of the foreign tax offices indicated in the notices you receive.
The European Commission indicates that payments made to your country of identification after your country of consumption has been reminded will not be forwarded, but may be refunded. Always check the content of the letter.
Installments and foreclosure are not resolved by a single mechanism
Poland will not spread the entire OSS into one plan
The country of identification cannot offer a plan for the entire OSS claim. Any solution must be agreed separately with the relevant country of consumption in accordance with its law.
Control can lead to exclusion
Repeated problems with declarations, payments, or records may meet the persistent infringement test. Detailed thresholds and the two-year exclusion period are described in the OSS VAT exclusion.
How to prepare an OSS control package?
The data set should lead from a specific transaction through the place of taxation and rate to the declaration and payment.

- Shipping and delivery country
- VAT and VIES numbers
- Invoices and corrective documents
