Reverse charge in Belgium – when does the buyer settle VAT?
Reverse charge in Belgium means that the buyer, instead of the seller, settles the VAT due on a transaction. However, this isn't a universal mechanism. Belgian regulations provide for several different types of auto-liquidation , including for B2B services, foreign suppliers, and real estate projects.
A Belgian VAT number alone doesn't determine your taxable income. First, determine the place of taxation, the status of both parties, and the contribution of any fixed establishment. General VAT rules in Belgium.

- The customer pays the price and VAT to the seller
- The seller reports the VAT due
Reverse charge
- The seller issues an invoice without VAT
- The buyer calculates and reports the VAT due
- The buyer deducts VAT to the extent applicable
Reverse charge does not mean exemption from VAT
Reverse charge is not an exemption or a 0% rate. VAT remains due and is settled by the purchaser.
| Mechanism | Why doesn't the seller charge VAT? |
|---|---|
| Reverse charge | The obligation to settle passes to the buyer. |
| 0% rate | A 0% tax rate applies to transactions. |
| WDT | The delivery benefits from the exemption under the conditions of an intra-EU transaction. |
| Export | The exemption results from the relevant export conditions. |
| Outside Belgian VAT | The transaction is not taxable in Belgium. |
What is the legal basis for reverse charge in Belgium?
| Provision of the directive | What does it regulate? | Importance for the company |
|---|---|---|
| Article 193 | General rule | VAT is settled by the seller, unless the relevant provision indicates another person. |
| Article 194 | Supplier not established | The state may pass on VAT to the purchaser; the conditions of Belgian law are necessary. |
| Article 196 | Specific B2B services | VAT is settled by the relevant service recipient if the service provider is not established in the taxing country. |
| Article 197 | Simplified three-party transactions | Transfer of the obligation to the final purchaser under simplification conditions. |
Articles 193–197 of the VAT Directive distinguish between the principle of settlement by the seller and individual cases of transfer of the obligation to the purchaser.
Reverse charge for B2B services – the most common case
- Polish service provider.Standard service, e.g. marketing or consulting. The service provider is not established in Belgium for this transaction.
- Belgian B2B buyerThe service is subject to the general place of supply principle: Belgium, as the country of the relevant service recipient.
- Customer settlementInvoice excluding Belgian VAT. Buyer: basis in 88, VAT due in 55 and deduction in 59, if applicable.

A foreign company makes domestic sales in Belgium – can it apply reverse charge?
A foreign supplier may apply the Belgian reverse charge in certain cases. The terms must be confirmed for each specific delivery.
- Type of transaction and its place of taxation.
- The customer's tax status, not just their VAT BE.
- Obligation to submit Belgian periodic declarations.
- Headquarters and any permanent place of business of the seller.
- The Belgian site's share in this delivery.
- A specific provision transferring VAT to the purchaser.
Does a seller's Belgian VAT number exclude reverse charge?
A BE VAT number does not exclude reverse charge. Tax registration and establishing a company in Belgium are separate arrangements.
What does a VAT number confirm?
Belgian taxpayer identification. The number alone does not prove that the company has its registered office or permanent establishment in Belgium. See the BE VAT number.
What needs to be examined additionally?
- Is there a Belgian permanent establishment?
- Is he involved in a given transaction?
- What provision specifies the person settling VAT?
Reverse charge and a permanent establishment in Belgium
A permanent establishment participates in the transaction
For this transaction, the foreign seller may be treated as established in Belgium. The mechanism for non-established suppliers may then not apply.
Permanent seat does not participate
For this transaction, the taxpayer may still be treated as not established. Administrative support from the facility alone does not constitute participation.
The importance of the establishment's participation stems from Article 192a of the VAT Directive and Articles 11 and 53 of Implementing Regulation 282/2011. Merely having a VAT number does not constitute a fixed establishment. However, if a fixed establishment exists, an invoice bearing its VAT number may create a presumption of participation, which can be rebutted by evidence.
Reverse charge in construction works in Belgium
Work involving Belgian real estate is subject to separate analysis. Do not automatically apply the standard B2B rule under Article 196 to these works.
| Performer | What to check? |
|---|---|
| Established in Belgium | Art. 20 royal decree n°1: eligible works and the obligation for the purchaser to submit periodic declarations. |
| Not established in Belgium | Art. 51 TVA Code: status and place of establishment of the client, declarations and any responsible representative. |
Change from January 1, 2023.
Article 20 expands the scope of buyers to include, among others, foreign taxpayers with direct identification. This change does not standardize the conditions for each case involving a foreign contractor.
Special information on the invoice
The model article 20 provides for an additional notice regarding auto-liquidation and customer status. A buyer who does not submit periodic declarations should inform the contractor.
The scope of the change is confirmed by Article 13 of the Royal Decree of 26 October 2022.These cases are distinguished by SPF Finances in the information for foreign contractors.
Reverse charge for gold and emission allowances
Belgium also provides for reverse charge for certain sectoral transactions. These rules should not be extended to regular e-commerce sales.
Specified gold deliveries
The mechanism covers designated gold deliveries, including taxable deliveries of investment gold and specified products. The national basis is contained in Article 20bis Royal Decree No. 1.
Emission allowances
The transfer of the indicated powers and units is subject to a separate mechanism under Article 20ter Royal Decree No. 1.
Reverse charge in a three-party transaction
- A / State 1Sells goods to intermediary B.
- B / country 2Sells the goods to the final buyer C.
- C / country 3The goods go directly A → C. If the conditions for simplification are met, VAT is settled by the final purchaser.
Reverse charge and WNT – are they the same?
| Mechanism | Base | VAT due | Deduction |
|---|---|---|---|
| WNT | 86 | 55 | 59, if applicable |
| Domestic reverse charge | 87 | 56 | 59, if applicable |
| Intra-EU B2B service | 88 | 55 | 59, if applicable |
| Import from ET14000 | 87 | 57 | 59, if applicable |
Reverse charge and ET14000 – it is not the same mechanism
- Imports from outside the EUBelgian import VAT is created.
- Granted ET14000VAT settled in the declaration instead of payment at check-in.
- Importer's declarationBasis in 87, VAT due in 57, deduction in 59 to the extent applicable.
The method of reporting deferred imports is described by SPF Finances in terms of ET14000.
Reverse charge and tax representative
A tax representative doesn't automatically trigger a reverse charge. Their status may be one of the conditions for a specific mechanism.
- Determine the basisWhich provision transfers VAT to the purchaser for this operation?
- Check the client.Where is he established? How is he identified? Does he file periodic declarations?
- Confirm RepresentationDoes the regulation require an approved responsible representative?
Reverse charge and invoice – what must the seller do?
A reverse charge invoice indicates that the obligation has been transferred to the buyer. The seller does not charge VAT and does not mark this transaction as a standard 0% rate.
Example: standard PL → BE service
- Seller / buyer
- Company PL / Company BE
- Value of the service
- 10,000 EUR
- Seller's VAT
- No VAT charged
- Annotation
- Autoliquidation / Reverse charge
How does a Belgian client settle this?
2,100 EURVAT due at an assumed rate of 21%: 10,000 × 21%. Deduction of the same amount is only possible with full right of deduction.
The obligation to indicate the reverse charge results from Article 226 point 11a of the VAT Directive.
How does a seller report reverse charge in a Belgian VAT return?
| Operation/Role | Base | VAT due |
|---|---|---|
| Seller: qualifying domestic VAT transaction of the buyer | 45 | Settles by the buyer |
| Buyer: domestic reverse charge | 87 | 56 |
| Buyer: Standard B2B service from the EU | 88 | 55 |
| Seller: B2B service to another EU country in the Belgian declaration | 44 | The correct buyer settles the bill |
| Seller: WDT from Belgium | 46 | Exemption under the terms of the WDT |
The deduction is not automatic
Field 59 covers deductible VAT. You determine your obligation to report output VAT and your right to deduct separately.
Example: IT service from Poland
EUR 20,000 net × 21% = EUR 4,200 VAT. Belgian customer: 88 → EUR 20,000, 55 → EUR 4,200, and with full deduction 59 → EUR 4,200.
The scope of field 45 is described in the official VAT declaration instructions, still available on the Intervat models and instructions.
Does reverse charge eliminate the seller's VAT registration obligation?
Only proper reverse charge
If customers correctly settle all Belgian company transactions in reverse charge, local registration may not be necessary for these transactions.
Other Belgian operations
Imports, intra-Community acquisitions, own goods movements, warehousing activities, or sales without reverse charge may still require VAT BE. Examine your entire business model.
Consulting service from Poland
The company operates from Poland, without a Belgian office, warehouse, or other operations. Standard B2B service for Belgian taxpayers: the client settles VAT; the service itself does not automatically result in BE VAT registration.
Goods from a Belgian warehouse
A Polish company has BE VAT and sells to a Belgian customer. This is a domestic delivery. Before invoicing, it's important to verify the parties' status and the correct basis, not just the country of residence.
Renovation of the Belgian hall
Place of taxation: Belgium. The client files periodic declarations. For non-established contractors, see Article 51; Article 20 separately regulates the work of contractors established in Belgium.
Consumer service
Don't resort to the usual B2B reverse charge. Establish proper B2C rules, seller VAT, and possible OSS or local registration.
Reverse charge and OSS
OSS and reverse charge are governed by different obligations. The appropriate model depends on the transaction and the customer's status.
Reverse charge / proper B2B transactions
VAT is settled by the buyer. The seller issues an invoice with the appropriate mechanism marked.
OSS / Qualifying B2C Sales
The seller still settles VAT, but uses a single procedure for the sales covered by it. The rules are explained in the OSS VAT returns.
Reverse charge a Peppol in Belgium
Reverse charge: who settles the tax?
Defines the buyer's VAT liability. The absence of a VAT amount on the invoice does not mean there are no invoicing obligations.
Peppol: how to send an invoice?
This applies to the form and transmission of invoices in cases covered by the Belgian obligation. The scope is explained by Peppol and e-invoicing in Belgium.

FAQ – reverse charge in Belgium
What does reverse charge mean in Belgium?
Output VAT is settled by the buyer instead of the seller. Applying this mechanism requires an appropriate legal basis for the transaction.
Can a Polish company issue an invoice without VAT to a Belgian customer?
Yes, if the transaction meets the conditions for reverse charge or another appropriate mechanism. The customer's Polish registered office and VAT number alone are not sufficient.
Does a Belgian customer settle VAT on every service provided from Poland?
No. For many standard B2B services, the Belgian buyer is responsible for paying the tax. Exceptions regarding the place of supply require separate analysis.
Is the customer's BE VAT number sufficient for reverse charge?
No. Depending on the mechanism, you must also confirm the customer's status, declaration obligations, and other transaction conditions.
Does the seller's BE VAT number exclude reverse charge?
Not automatically. Belgian VAT identification does not imply a registered office or fixed establishment involved in the transaction.
Are construction works subject to reverse charge?
Certain works may be subject to the Belgian reverse charge. It's important to distinguish between established and unestablished contractors and verify the client's status.
Where does a Belgian customer get a standard B2B service from Poland?
Generally, the basis is shown in field 88 and the VAT payable in field 55. Field 59 covers only deductible VAT.
What fields apply to domestic reverse charge?
For the relevant national mechanisms, the purchaser generally uses 87 for the base and 56 for output VAT. The deduction is reported in 59 to the extent applicable.
Where does the seller report domestic sales with VAT settled by the buyer?
In the Belgian declaration, the relevant operations are included in field 45. This is not a universal field for every non-VAT invoice.
Will the buyer always deduct the entire VAT from the reverse charge?
No. Output VAT must be accounted for regardless of the scope of deduction. Deduction depends on the use of the purchase and the buyer's eligibility.
